Man Contest Rules

1.
HOW TO ENTER
a.
The KSCF/ Sophie@103.7
“Marathon Man” contest will begin on April 28, 2008 at 12:01 am Pacific Time
(“PT”) and end on June 8, 2008 at 11:59 pm PT.
b.
To participate
in the contest, you may enter via the following method(s):
1.
Enter On-Line. Beginning on April 28, 2008 at 12:01 am PT, log
onto www.RadioSophie.com, locate the “Marathon Man” webpage and complete the online entry form
including your first name and last name,
complete address, city, state, zip code, home telephone number and a valid
email address. Entrants are also required to upload a photograph of themselves
and submit it with their entry. All photos submitted must be in jpg. or gif. format
with no maximum size requirement. All entries must be received by May 18, 2008
at 3:00pm PT.
2.
In order to submit a photograph,
entrants must read and agree to the online release by clicking on the "I
Accept" button. Only entrants that affirmatively agree to the terms of
the release will be able to submit an entry in as part of the contest. Only
one internet entry per person and one internet entry per email address is
permitted. Internet entries will be deemed made by the authorized account
holder of the email address submitted at the time of entry. The authorized
account holder is the natural person who is assigned to the email address by an
internet access provider, online service provider or other organization that is
responsible by assigning email address or the domain associated with the
submitted email address. For purposes of these Official rules, “receipt” of an
online entry occurs when the www.RadioSophie.com servers record the entry information
upon clicking the submit button. Any automated computer receipt (such as one
confirming delivery of the e-mail) does not constitute proof of actual receipt
by Sophie@103.7 of an online entry for purposes of these official rules. The
Station is not responsible for entries not received due to difficulty accessing
the internet, service outage or delays, computer difficulties or other
technological glitches.
c.
Photographs submitted as part of
this contest must be the original creative work and/or property of the contestant
and must not contain copyrighted materials or any other materials, which may be
restricted, prohibited, or outlawed by Federal, state or local laws.
SOPHIE@103.7, at its sole discretion, reserves the right to disqualify any photo
entry if such photo contains illegal, indecent, pornographic, sexually explicit
content, or otherwise offensive material such as aberrational behavior, graphic violence or
drug abuse, or if such entry contains material whose content is deemed at the
sole discretion of SOPHIE@103.7 to be unsuitable for public viewing. Each photo entry submitted in contest will become property of
SOPHIE@103.7 and will not be returned.
d.
Photo must display only the
entrant and no other individuals or personally identifiable features of any
other individual.
e.
One entry per person per email
address, and only entry per person regardless of means of entry.
f.
The contest is open to male
listeners only.
2.
ELIGIBILITY
RESTRICTIONS
a.
The contest is
open to male listeners 21 years of age or older and who reside in San Diego
County in the state of California. Employees of Sophie@103.7
(the Station), its licensee, its corporate parents, subsidiaries, and
affiliates, its advertising agencies, participating sponsors/promotional
partners, other radio stations in the San Diego metropolitan area and the
members of their immediate families and/or households are ineligible to
participate or win.
b.
Listeners are
eligible to win a Station contest only once every thirty days, and a prize
valued at $1,000 or greater only once every six months. Only one winner per
household is permitted in any station contest.
c.
Winner must
provide valid government-issued photo identification upon receipt of prize.
Winner must also complete station release form and provide Social Security
Number. If the prize value is over $600 winner is required to complete a W-9
Form.
d.
Contestants are
required to provide truthful information and the Station will reject and delete
any entry that it discovers to be false or fraudulent. The Station will
disqualify any entry from individuals who do not meet the eligibility
requirements, and the Station will also delete any entry received from persons
under the age of 13 in compliance with the Children’s Online Privacy Protection
Act.
3.
PRIZES
a.
One (1) grand prize will be
awarded. The grand prize consists of a trip to San Francisco for winner to
participate in the sold out Nike Women's Marathon and Half Marathon scheduled
for October 19th, 2008, including paid registration into the race, the opportunity
to train with the Team In Training Marathon Team, receive professional
coaching, one round trip (coach airfare) ticket to the Bay Area on the available Team flight
(dates of travel must leave San Diego on Friday, October 17th returning to San
Diego on Monday, October 20th), ground transportation with Team to
hotel and back to airport, three (3) nights accommodation at the Team
hotel near Union Square (includes half a room shared with another
team member, with the option to have the room to themselves by purchasing
the other half), one pasta Party Ticket (Saturday night dinner), one
Victory Party ticket (Sunday night dinner), one Team In Training race day
jersey, and upon completion of Nike Half or Full Marathon one
finishers medal and finishers shirt. Participant must recommit with Team
In Training Marathon Team by June 26, 2008 to ensure travel and race
entry. Approximate Retail Value: $1,000.
b.
Certain restrictions may apply.
All other costs not specifically stated herein, are the responsibility of the
winners. Grand prize winner is responsible for obtaining all required travel
documents. Winner is solely responsible for obtaining travel insurance (and
all forms of insurance) where applicable, at their option, and hereby
acknowledge that the Station has not and will not obtain or provide travel
insurance or any other form of insurance. Any winners of certificates/vouchers
will be subject to the terms and conditions as set forth by the provider of the
certificate/voucher. Grand prize winner and travel companion are solely
responsible for all applicable taxes including but not limited to hotel,
hospitality and airport taxes, telephone charges, meals, gratuities, ground
transportation and any other expenses not specifically offered herein. Grand
prize winner may be required to present a valid credit card upon hotel check-in
to cover incidental expenses incurred during stay. Other restrictions may
apply.
d. All prizes or prize
certificates may be picked up at the office of the Station at the address
below. The winner will forfeit any prize or prize certificate not claimed by July
8, 2008. Under no circumstances does the station mail out any prize/prizes. If
prize must be picked up at location other than the station, the winner will be
notified within 24 hours of the event by station employee.
e. There is no
substitution, transfer, or cash equivalent for prizes, except that Sponsor may,
at its sole discretion, substitute prizes of comparable value or cash. The
prizes are expressly limited to the item(s) listed above and do not include
taxes, gratuities or any other expenses. Other restrictions may apply.
4.
WINNER
SELECTION AND NOTIFICATION
a.
Decisions of
Station management with respect to the contest are final.
b.
All eligible
entrants’ photos will be posted on the www.RadioSophie.com
website within forty-two (42) hours of submission. Beginning on May 19, 2008
at 12:01am PT, listeners will be able to log onto www.RadioSophie.com and vote on their
favorite “Marathon Man” by clicking “vote” below their chosen entrant’s photo.
The entrant with the most votes accumulated via the Sophie@103.7 website by June
8, 2008 at 11:59pm PT, will automatically be designated the winner. Winner
will be contacted by phone or email after selection.
c.
If in the event
of a tie (two or more entries with the same number of highest votes) the final
winner will be selected in a random drawing from the tying entries.
d.
There is a one
vote limit per computer IP address.
e.
Listeners need
not listen or be present to win.
f.
If
the winner cannot be contacted within two (2) days of the initial notification
attempt, the winner forfeits prize and the next highest voted contestant will
be selected as an alternate winner
g.
Grand prize
winner must complete winner release and Release of Liability Prize Acceptance
form within thirty (30) days or prize will be forfeited and an alternate winner
will not be selected. If a potential winner cannot be contacted, fails to sign
and return the required affidavit of eligibility and liability/publicity
release within the required time period, or if a prize or prize notification is
returned as undeliverable, potential winner forfeits prize.
5.
CONDITIONS
a.
Payments of all
federal, state and local taxes are solely the responsibility of the winners.
Winners may be required to sign an IRS Form W-9 or the equivalent.
b.
By participating
in the contest, winner agrees to have his/her name, voice, or likeness used in
any advertising or broadcasting material relating to this contest without
additional financial or other compensation, and, where legal, to sign a
publicity release confirming such consent prior to acceptance of the prize.
c.
Prior to
awarding any prize or prize certificate, the Station in its sole discretion may
require contest winners to sign a liability release, agreeing to hold the
Station, its corporate licensee, its parent, subsidiary and affiliated
corporations, and the officers, shareholders, directors, employees, agents and
representatives of each of them harmless against any and all claims or
liability arising directly or indirectly from the prize or participation in the
contest.
d.
The Station, in
is sole discretion, reserves the right to disqualify any person tampering with
the entry process, the operation of the Station’s website or is otherwise in
violation of the rules. It further reserves the right to cancel, terminate or
modify the contest if it is not capable of completion as planned, including
infection by computer virus, bugs, tampering, unauthorized intervention or
technical failures of any sort.
e.
The Station
reserves the right to make changes in the rules of the contest, including the
substitution of a prize of equivalent value, which will become effective upon
announcement. If due to circumstances beyond the control of the Station, any
competition or prize-related event is delayed, rescheduled, postponed or
cancelled, the Station reserves the right, but not the obligation, to cancel or
modify the contest and shall not be required to award a substitute prize.
f.
Failure to
comply with the contest rules may result in a contestant’s disqualification
solely at the discretion of the Station.
g.
The Station is
not responsible for typographical or other errors in the printing, the offering
or the administration of the contest, or in the announcement of a prize.
h.
Copies of the
written contest rules and a list of winners (when complete) are available
during regular business hours at the main studios of Sophie@103.7 located at
8033 Linda Vista Road, San Diego, CA 92111.
6.
INTERNET
SWEEPSTAKES PRIVACY POLICY
a.
By use of this
website and by entering the Contest, you agree to the Station’s Web Site Terms
of Use Agreement and to the use of your personal information as described in
